What Happens to Presidential Records – Myths, Ironies and Facts
Did you know that you can access presidential records through the Freedom of Information Act (FOIA), but not until five years after the President leaves office? The Presidential Records Act (PRA) of 1978, 44 U.S.C. §§ 2201-2209, governs the official records of Presidents and Vice Presidents that were created or received after January 20, 1981 (think Reagan Administration). The PRA changed the legal ownership of the President’s official records from private to public and established a new structure under which NARA owns and provides access to the records of Presidents after they leave office.
It seems pretty clear, so why all of the confusion when it comes to ownership, timing, personal versus Presidential records, Presidential rights to restrict access, and so much more? Add to that the major change in Presidential Libraries. Listen and learn as the experts talk about the controversies, debunk the myths, and show how public access serves the Nation’s best interest.
